29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.  On or about February 19, 2016, at 6655 Vicksburg, New Orleans, LA the employer failed to ensure that employees wore hard hats while exposed to overhead hazards. Employees were working on the second and third level of the scaffold system.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  On or about February 19, 2016 at 6655 Vicksburg Street, New Orleans, LA the employer failed to ensure that the scaffold was fully planked. The scaffold had 3 planks where 6 are required. Employees were performing masonry operations while on the scaffold.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed  according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91m) wide.  On or about February 19, 2016, at 6655 Vicksburg, New Orleans, LA the employer failed to ensure that the scaffold system was tied into the structure as recommended by the manufacturer. Employees were performing masonry work from the scaffold system that was approximately 30 feet in height.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross braces were used as a means of access.  On or about February 19, 2016, at 6655 Vicksburg, New Orleans, LA, the employer failed to ensure that the scaffold system was complete with a ladder for access and egress. Employees used the scaffold members as a means of access and egress.

Employees were using the scaffold system to apply stucco to the structure.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toe boards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.  On or about February 19, 2016, at 6655 Vicksburg, New Orleans, LA the employer failed to ensure that toe boards were installed on all working levels. An employee was performing masonry work on the second level while work was being performed overhead.
