29 CFR 1910.1200(h)(1): Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(2) and (h)(3) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) Two laborers who was potentially exposed to such hazardous chemicals as silica, mortar, Bituthene Mastic and gasoline had not received information and training as indicated above. (b) As of February 17, 2016, the employer had not trained employees on the new chemical container label elements and the new format and types of information on each section of safety data sheets (SDSs). ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coatings, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and was not equipped as to enable employees to remove such substances: (a) Adequate washing facilities were not provided for employees who were engaged in mixing, transporting, and applying mortar while performing masonry work (i.e., laying block) at the job site. Lack of washing facilities could result in employees receiving chemical burns to the skin. Potable water was available through water hoses at the site, but soap and hand towels were not provided. ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided: (a) Two laborers and a foreman who were exposed to mortar while mixing, shoveling and transporting it to masons were wearing rubber palmed gloves which had holes in them. Employees were observed getting mortar on their hands due to this condition. ABATEMENT CERTIFICATION IS REQUIRED
