OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to a crushing hazard. On or about February 18, 2016 the employer allowed employees to operate three (3) Nissan forklifts without seatbelts throughout the facility. A. Nissan 50 Forklift, Unit #1, in the powder manufacturing warehouse. B. Nissan 50 Forklift, Unit #3, in the manufacturing warehouse. C. Nissan 50 Forklift, Unit #5.
