OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards:    a) Worksite was located at Route 21 SB and Chester Avenue, Newark, NJ     Employees were exposed to the hazard of being struck by construction vehicles within a highway construction zone. The employer did not document a pre-planned traffic pattern for pedestrian and construction traffic when operating in order to ensure the safety of the employees working and walking within the construction work zone.      Violation occurred on or about 9/14/15.

29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.    a) Worksite was located at Route 21 SB Viaduct and Chester Avenue Newark, NJ.    Employees were exposed to a scaffold stair tower that had a bent cross brace on the south elevation. The scaffold was in service during the inspection.    Violation occurred on or about 2/19/2016.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews.    a) Work site was located at Route 21 SB Viaduct and Chester Avenue Newark, NJ.    Employees were exposed to a scaffold platform at the upper elevation that had top edge height of its toprails set above 45 inches with no midrail or toe kick installed exposing employees to a fall of approximately 14 feet.    Violation was observed on or about 2/19/2016.
