OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed a struck by hazard: On or about February 23, 2016, at the above addressed worksite, two employees were exposed to being struck by vehicular traffic while working within a work zone delineated with orange cones and a single barricade in a highway traffic lane without wearing high-visibility safety vests.
