29 CFR 1910.23(c)(1): Every open-sided floor or platform four feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides: a. On the Shumaker 2 oil well site where oil is pumped from the ground then through a separator to a storage tank, the employee going on top of the storage tank to check the amount of oil in the tank were not protected with a fall protection system, thereby exposing the employees to a ten foot, four inch fall hazard. b. On the McCoy Unit #3 oil well where oil is pumped from the ground then through a separator to a storage tank, the employee going on top of the storage tank to check the amount of oil in the tank were not protected with a fall protection system, thereby exposing the employees to a ten foot, four inch fall hazard. c. On the Eberly #1 oil well site where oil is pumped from the ground then through a separator to a storage tank, the employee going on top of the storage tank to check the amount of oil in the tank were not protected with a fall protection system, thereby exposing the employees to a 15 foot, five inch fall hazard. d. On the Daughtery 2 oil well site where oil is pumped from the ground then through a separator to a storage tank, the employee going on top of the storage tank to check the amount of oil in the tank were not protected with a fall protection system, thereby exposing the employees to a ten foot, four inch fall hazard. e. On the Sheplar 1a oil well site where oil is pumped from the ground then through a separator to a storage tank, the employee going on top of the storage tank to check the amount of oil in the tank were not protected with a fall protection system, thereby exposing the employees to a ten foot, four inch fall hazard. f. On the Lawrey 1 oil well site where oil is pumped from the ground then through a separator to a storage tank, the employee going on top of the storage tank to check the amount of oil in the tank were not protected with a fall protection system, thereby exposing the employees to a ten foot, four in fall hazard. g. On the McCoy #3 where employees crossed from one tank to the other tank, employees were walking across a two inch by 12 inch board to gain access to the other tank, thereby exposing employees to a ten foot fall hazard. h. On the Daughtery #2 where employees crossed from one tank to the other tank, employees were walking across a 11 inch by eight foot, six inch board to gain access to the other tank, thereby exposing employees to a ten foot fall hazard. i. On the Sheplar 1a where employees crossed from one tank to the other tank, employees were walking across a two inch by 12 inch board to gain access to the other tank thereby exposing employees to a ten foot fall hazard.

29 CFR 1910.24(b): "Where fixed stairs are required." Fixed stairs shall be provided for access from one structure level to another where operations necessitate regular travel between levels, and for access to operating platforms at any equipment which requires attention routinely during operations. Fixed stairs shall also be provided where access to elevations is daily or at each shift for such purposes as gauging, inspection, regular maintenance, etc., where such work may expose employees to acids, caustics, gases, or other harmful substances, or for which purposes the carrying of tools or equipment by hand is normally required. (It is not the intent of this section to preclude the use of fixed ladders for access to elevated tanks, towers, and similar structures, overhead traveling cranes, etc., where the use of fixed ladders is common practice.) Spiral stairways shall not be permitted except for special limited usage and secondary access situations where it is not practical to provide a conventional stairway. Winding stairways may be installed on tanks and similar round structures where the diameter of the structure is not less than five (5) feet: a. On the Shumaker 2 well site were employees climb stairs to gain access to the top of the storage tank to guage the contents of the storage, the stairway was not provided with handrails on both sides of the stairway, thereby exposing employees to a fall hazard. b. On the McCoy Unit #3 oil well site were employees climb stairs to gain access to the top of the storage tank to gauge the contents of the storage, the stairway was not provided with handrails on both sides of the stairway, thereby exposing employees to a fall hazard. c. On the Eberly 1 oil well site were employees climb stairs to gain access to the top of the storage tank to gauge the contents of the storage, the stairway was not provided with handrails on both sides of the stairway thereby exposing employees to a fall hazard. d. On the Daughtery 2 oil well site where employees climb stairs to gain access to the top of the storage tank to gauge the contents of the storage, the stairway was not provided with handrails on both sides of the stairway thereby exposing employees to a fall hazard. e. On the Sheplar 1a oil well site were employees climb stairs to gain access to the top of the storage tank to gauge the contents of the storage, the stairway was not provided with handrails on both sides of the stairway thereby exposing employees to a fall hazard. f. On the Lawry 1 oil well site were employees climb stairs to gain access to the top of the storage tank to gauge the contents of the storage, the stairway was not provided with handrails on both sides of the stairway thereby exposing employees to a fall hazard. g. On the Yoder 18-1 where employees went to the top of the stairway to gauge the tank for the amount of oil in the tank, there was no guardrail thereby exposing employees to a fall hazard.

At the Daughtery 2 oil well site where employees started a motor used to pump oil from the well to the separator, the employer did not ensure that the guarding enclosed the belt and pulley, thereby exposing employees to a caught-in hazard. d. At the Sheplar 1a oil well site where employees started a motor used to pump oil from the well to the separator, the employer did not ensure that the guarding enclosed the belt and pulley, thereby exposing employees to a caught-in hazard.
