29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  (a) Top plate, new townhome construction located at 2188 Peach Lane, Smyrna, GA 30080: Employee was exposed to eye injuries while operating a Hitachi (Model - NR83A3S) 3-1/4-inch Strip Framing Nail Gun without protective eyewear. The employee was exposed to struck-by hazards which included plastic collated debris and metal fasteners as safety glasses and/or goggle were not worn.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Third floor top plate, new townhome construction located at 2188 Peach Lane, Smyrna, GA 30080: Employee was exposed to falls of approximately 31-feet, 10-inches to the lower level while engaged in framing activities on a 2x4 top plate without a fall protection system in place.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Front side, new townhome construction located at 2188 Peach Lane, Smyrna, GA 30080: Employee was exposed to falls of approximately 7-feet, 5-inches to the lower level while accessing a ladder which was not extended at least 3-feet past the landing to allow safe access to the upper and lower levels. The ladder used was a step ladder which was used in the closed position with a maximum height of 5-feet, 8-inches.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) Temporary electrical box on front side, new townhome construction located at 2188 Peach Lane, Smyrna, GA 30080: The employer failed to inspect all of the electrical cords used on site prior to the start of the work shift. A 50 ft. extension/flexible cord used to power a Makita Circular Saw was missing a ground pin and was not repaired or removed from service.
