At the jobsite, a safe means of egress was not provided to an employee who was working in a trench with type "C" soil which was 5 feet 6 inches deep, 7 feet long, and 9 feet wide, exposing the employee to an entrapment hazard, on or about 2/24/16.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a. At the jobsite, an employee, who was the competent person, was locating and replacing 45 degree elbows on a 10 inch water line that was at the bottom of a 5-1/2 feet deep trench in type "C" soil that had nearly vertical walls, with cracks and fissures on the trench walls and standing water in the trench. Although he observed these conditions, he did not remove himself from the excavation.
