29 CFR 1926.404(b)(1)(ii): Ground-fault circuit interrupters. All 120-volt, single-phase 15- and 20-ampere receptacle outlets on construction sites, which are not a part of the permanent wiring of the building or structure and which are in use by employees, shall have approved ground-fault circuit interrupters for personnel protection. Receptacles on a two-wire, single-phase portable or vehicle-mounted generator rated not more than 5kW, where the circuit conductors of the generator are insulated from the generator frame and all other grounded surfaces, need not be protected with ground-fault circuit interrupters. 321/323 Canal St., NY, NY: On or about 02/22/2016, employees of E & S and Sons Corp. using hand power tools, were exposed to potential shock hazards due to the fact that they were not using ground fault circuit interrupters. There was no assured equipment grounding conductor program for this project. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: 321/323 Canal St., NY, NY: On or about 02/22/2016, employees of E & S and Sons Corp. using a Porter Cable Chop saw were exposed to potential shock hazards. The grounding pin on the saw's cord had been removed, interrupting the path to ground.
