29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   a)  Feldmeier/Alabama Equipment, Inc.:   On or about March 29th, 2016 an employee was exposed to noise dose at levels of 107.9 % (equivalent to an 8 hour time weighted average TWA of 91.19 dBA) which is 2.16 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while grinding stainless steel metal to fabricate stainless steel tanks. Results were calculated for a 441 minute sampling period.

29 CFR 1910.95(l)(1): The employer did not make available to affected employees or their representatives copies of 29 CFR 1910.95 and did not post a copy in the workplace:  a)  Feldmeier/Alabama Equipment, Inc.:   On or about March 29th, 2016 an employee was exposed to noise dose at levels of 107.9 % (equivalent to an 8 hour time weighted average TWA of 91.19 dBA) which is 2.16 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while grinding stainless steel metal to fabricate stainless steel tanks. Results were calculated for a 441 minute sampling period.  Employee was not provided a copy of the standard and the standard was not posted on site.

29 CFR 1910.1200(f)(6)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings:    a)Feldmeier/Alabama Equipment, Inc.:  On or about March 29th, 2016, and prior to, the employer exposed employees to hazards of unlabeled container without identification of the hazard of the chemical  and identification of the contents of a self-closing flammable container that contained a flammable product called Lacquer Thinner 2000 (LT 2000).
