29 CFR 1926.300(b)(4)(ii): The point of operation of machine(s) whose operation exposed an employee to injury was not guarded:   a) On or about 02/23/16, in the Front Lobby on the west side, and in the north end corridor at the Niagara Falls State Park Police Station under construction at 555 Whirlpool Street,  Niagara Falls, NY:  The employer  made up three  negative air machines by disassembling old machines such as furnaces  and using parts in their shop. These machines were cord & plug connected, 120 volt-ac. Brackets were installed on the outside of the machines so a furnace filter could be dropped in and stay in place.  Behind the furnace filter was a rotating furnace blower wheel.  The furnace filter was not a proper guard for the rotating furnace blower wheel.  Additionally, there was a short circular piece of sheetmetal duct work on one of the narrow sides where the air was forced out. The end of the duct was open and employees could reach their arm into the duct and contact the rotating furnace blower wheel.  The entrance to the duct was not guarded.    NO ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:    a) On or about 02/23/16, in the Front Lobby on the west side, and in the north end corridor at the Niagara Falls State Park Police Station under construction at 555 Whirlpool Street, Niagara Falls, NY: The employer made up three negative air machines by disassembling old machines such as furnaces and using parts in their shop. These machines were cord & plug connected, 120 volt-ac, and all had three prong plugs (hot, neutral, & ground).  Although all the extension cords in the series of cords connecting the negative air machines to the temporary power panel were properly grounded, none of the negative air machines were grounded because the green conductor inside the power cord of each machine was either cut off or not connected to anything once inside the machine.     NO ABATEMENT DOCUMENTATION REQUIRED

A means shall be provided to disconnect each appliance:     a) On or about 02/23/16, in the Front Lobby on the west side, and in the north end corridor at the Niagara Falls State Park Police Station under construction at 555 Whirlpool Street, Niagara Falls, NY: The employer made up three negative air machines by disassembling old machines such as furnaces and using parts in their shop.  These machines were cord & plug connected to 120 volt-ac power.  There was no on/off switch and employees turned the machines on and off by plugging and unplugging the cord, creating an arcing hazard.    NO ABATEMENT DOCUMENTATION REQUIRED

These machines were cord & plug connected, 120 volt-ac  and had both electrical and mechanical hazards. The negative air machines had no label and were not approved by a Nationally Recognized Testing Laboratory (NRTL).      NO ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.405(b)(1): Conductors entering boxes, cabinets, and fittings were not protected from abrasion:   a) On or about 02/23/16, in the Front Lobby on the west side at the Niagara Falls State Park Police Station under construction at 555 Whirlpool Street, Niagara Falls, NY: The employer installed a Goodman furnace to provide heat in the building. Temporary wiring using a flexible cord and plug was used to provide 120 volt-ac power  to the furnace. The three conductors  in the power cord were exposed and were not protected from abrasion at the opening in the furnace where they passed through.   NO ABATEMENT CERTIFICATION REQUIRED
