29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a)  At L & L Machine and Tool, Machine Number 1, Opelika, Alabama:  On or about February 23, 2016 and at times prior; the employer allowed his employee to operate a Bridgeport CNC Machine in manual mode and the machine did not have a chuck guard exposing the employee to struck-by hazard and caught-by hazards.  b)  At L & L Machine and Tool, Machine Number 2, Opelika, Alabama:  On or about February 23, 2016 and at times prior; the employer allowed his employee to operate a Bridgeport CNC Machine in manual mode and the machine did not have a chuck guard exposing the employee to struck-by hazard and caught-by hazards.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  a)  At L & L  Machine and Tool Opelika, Alabama:  On or about February 23, 2016 and at times prior; the employer exposed his employees to struck-by hazards in that employees were allowed to operate a powered industrial truck without the employer ensuring that the operators had received the required evaluation at least every three years as specified in the regulations.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)  At L & L Machine and Tool Opelika, Alabama:  On or about February 23, 2016 and at times prior; the employer exposed employees to chemical hazards in that employees were not provided the new information and training on the Global Harmonized System (GHS) to include Safety Data Sheets.
