OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards.     (a)Running Supply, Inc. @ 1706 Morningside Drive, Milbank, SD 57252: On or about February 22, 2016, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees, were directed to access the roof of the store to look for a roof leak. Employees used a 4' x 4' wide 31.5 inches in height, parts basket with the forklift to raise and lower employees from the roof. The basket was not designed to lift personnel. This condition exposed employees to fall hazards.     Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a piece of equipment designed to lift personnel to another platform or level equipped with a gate or door for safely entering and exiting as required by ANSI/ITSDF B56.1-2009, Sections 4.17.1 Only operator-up high lift trucks have been designed to lift personnel. If a work platform is used on trucks designed and intended for handling materials, the requirements of paragraphs 4.17.2 and 4.17.3 shall be met for protection of personnel.

29 CFR 1910.23(c)(1):  Open-sided floors or platforms 4 feet or more above adjacent floor or ground levels were not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder:       (a)Running Supply, Inc. @ 1706 Morningside Drive, Milbank, CO 57252:  On or about February 22, 2016, the employer did not ensure open-sided floors that were 4 feet or more above ground levels were guarded by a standard railing or the equivalent, in that, employees accessing the roof to check for leaks were not protected from falls. This condition exposed employees to fall hazards of 11 feet.

29 CFR 1910.110(f)(2)(ii): Containers when stored inside shall not be located near exits, stairways, or in areas normally used or intended for the safe exit of people.    (a)Running Supply, Inc. @ 1706 Morningside Drive, Milbank, SD 57252: On or about February 22, 2016, the employer did not ensure employees were protected from fire and explosion hazards associated with the storage of 80lb LPG cylinders. The cylinders were stored in close proximity to an exit in the warehouse. The condition exposed employees to fire hazards.
