Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while employees were lifted with a truck mounted crane:    (a) Facility Lot:  On February 25, 2016, an employee was exposed to a fall hazard of approximately 15 feet to ground level while being lifted by a truck crane, Simon-RO SN 1707107, and equipment that was not designed, constructed, installed, operated, tested, maintained, used or approved for personnel lifting.

29 CFR 1910.180(d)(5)(iii):  Standby cranes were not inspected at least semiannually in accordance with requirements of paragraph (d)(3) of this section and paragraph (g)(2)(ii) of this section. Such cranes which are exposed to adverse environment should be inspected more frequently:    (a)  Bingamon Corporation:  On February 25, 2016 and times prior, the employer operates a Simon-RO truck mounted crane (serial #1707107) to lift personnel and material.  The employer has not ensured that the crane was given the required inspections.

Two acetylene cylinders were stored 13 feet from three oxygen cylinders.

29 CFR 1910.1200(e)(1):   The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:     (a) Bingamon Corporation:  On February 20, 2016 and times prior, employees used diesel fuel, which is flammable, and Chevron Starplex EP grease, Havoline conventional antifreeze/coolant, and SAE 15W-40 motor oil.  The employer has not developed or implemented a written hazard communication program.     ABATEMENT NOTE:  A written program shall include a description of how the criteria for the following will be met:   1.        Labeling and other forms of warnings;   2.        Safety Data Sheets;   3.        Employee information and training.        Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks and the informing of contractors of workplace hazards, including a description of the labeling system used in the facility and the availability of safety data sheets must also be addressed.  The written program must be made available upon request.
