29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the Jobsite located at 6005 W 137th Street, Overland Park, KS 66221; the employer had not developed a written hazard communication program to address the hazards associated with chemicals used in the workplace including but not limited to concrete shingles and gasoline.  Employees engaged in roofing work, cutting concrete shingles and filling the Stihl radial saw with gasoline were exposed to hazards such as eye and skin irritation, and inhalation hazards from hazardous chemicals.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  At the Jobsite located at 6005 W 137th Street, Overland Park, KS 66221; employees had not been trained on hazardous chemicals in their work area, such as gasoline and concrete shingles.  Employees were exposed to eye and skin irritation and inhalation hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  Employees engaging in roofing activities at jobsite located at 6005 W 137th St. Overland Park KS, 66221 were exposed to fall hazards of approximately 14 feet. Employees were using a portable extension ladder to access the roof and the side rails of the ladder extended 2 feet above the eave of the roof.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  Employees engaging in roofing activities at jobsite located at 6005 W 137th St. Overland Park KS, 66221 were exposed to fall hazards of approximately 14 feet to the ground in that a portable aluminum extension ladder that had a damaged rung and damaged foot pad was used to access the roof.
