29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of the jobsite, materials, and equipment to be made by a competent person: (a) Centerline Solutions, LLC @ 481 So. Arthur Ave., Louisville, Colorado. On or before November 5, 2015, as part of the injury/accident prevention responsibilities under its safety program, the exposing employer did not ensure that a competent person conducted inspections of the job site, the excavation, and the adjacent areas for evidence of a situation that could have resulted in hazardous conditions. On November 5, 2015, an employee was permitted to work inside a trench within the proximity of a Caterpillar Mini-Excavator bucket while digging operations were occurring. The operator inadvertently activated an operational lever, causing the bucket to swing and strike the employee in the trench against the building wall, resulting in a broken ribs and punctured lung. Abatement note: The requirements and duties of a competent person are: (1) A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them. (2) The competent person must understand and be able to carry out the tasks specified in the OSHA standard. The competent person must also have knowledge about excavation protection systems or plans and the safety program. (3) An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.
