OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of  falling from and/or being struck and run over by heavy equipment.    a) At the Worksite, 1800 Old Country Rd. Riverhead, NY: An employee operating equipment fell off the  Komatsu Bulldozer and it ran over him; on or about 3/1/16.    Feasible methods of abatement include:      1.) Page 19 of the Association of the Equipment Manual (AEM) in the Work Safety Section states: "If equipped with ROPS, stay in the operator's seat at all times when operating and keep your seat belt/operator restraint fastened and comfortable snug."    2.) Page 9 of the Association of the Equipment Manual (AEM) in the Follow a safety program section, states: "These are some of the rules you must work by: Whenever you leave your machine, always lower the bucket, blade or other attachments to the ground. Engage the parking brake, stop the engine, cycle the hydraulic controls, and remove the key."    NOTE: In addition to abatement certification, the employer is required submit abatement documentation for this item in accordance with 29 CFR 1903.19.
