OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: struck by hazards caused by the movement of the Kobelco SK140SRLC excavator while positioning.     On or about February 26, 2016; the employer failed to protect employees from struck-by and crushing hazards while performing excavating operations. The employer required employees to work in close proximity with the Kobelco SK140SRLC excavator without maintaining the area around the equipment that the employees were not to enter.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury, in that:  a) ) Hwy 183 near Hwy 193, AL; On or about March 1, 2016; employees entered and worked in a trench measuring 5 feet 6 inches to 7 feet 6 inches deep, 11 feet wide, and 36 feet in length that was dug in class B soil that was not protected from cave-ins by an adequate protective system. Employees had not been provided effective information and training on recognizing and avoiding cave-in hazards on the work site.

29 CFR 1926.200(g)(2): Traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD), 1988 Edition, Revision 3, September 3, 1993, FHWA-SA-94-027 or Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, December 2000, FHWA.  (a) Hwy 188 and Bellingrath Rd. On or about March 1, 2016the employer failed to ensure signage used to inform traffic of employee presence did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD") Page 2A-9, Table 2A-4. Common Uses of Sign Colors in that the signs in use did not all have an orange background, exposing employees to struck-by hazards.

Developers, Inc.: On February 26, 2016 and at times prior, employees entered and worked in a trench measuring 5 feet 6 inches to 7 feet 6 inches deep, 11 feet wide, and 36 feet in length that was dug in class B soil and the employer failed to notify the OSHA Area Office within 24 hours that an employee suffered an amputation after a work related accident.
