OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees,  in that employees were exposed to fall hazards:  a) Site - On or about 02/24/16 and at times prior thereto employees rode on an agglomerated wood box attached to the forks of the JLG Model G10-55A rough terrain forklift in order to remove siding from chimneys. No fall protection equipment was in use, and workers were exposed to falls from an approximate 18 ft. elevation to ground level.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Site - On or about 02/24/16 and at times prior thereto employees operated the 7 in. Kobalt circular saw to cut siding materials without the use of eye-protective equipment.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a) Site - On or about 02/24/16 an employee was painting the siding on the chimney of Apartmernt #1301 from the platform of a JLG aerial boom lift Model 460 SJ without fall protection equipment, and was exposed to an 18 ft. fall to ground level.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Site - On or about 02/24/16 and at time prior thereto employees installed siding on top of the roof of Apartment #1705 without the use of fall protection equipment, and were exposed to 9.0 ft. falls to ground level.(Roof slope: 4:12).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
