29 CFR 1910.215(b)(9): Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.):    On or about 02/29/2016, an employee from Schreiter Ready Mix located at 200 S. Cool Spring Rd., OFallon, MO, was exposed to struck-by hazards.   The DeWalt bench grinder was without a tongue guard and therefore could not be adjusted to one-fourth inch.

29 CFR 1904.32(b)(3): How do I certify the annual summary? A company executive must certify that he or she has examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual summary is correct and complete:  The company executive, Mr. K. Schreiter, for Schreiter Ready Mix located at 200 S. Cool Spring Rd., OFallon, MO, did not certify the OSHA 300-A form for 2015 (nor the previous years of 2014 and 2013).  The Office Manager signed the forms.
