29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On or about March 2, 2016; Roof area of residential home (Westside); employees were exposed to an estimated fall of 30 footfall to ground level while removing the roof on the residential home; employees were tied off by tying a rope around their waist and anchoring by tying the rope around one of rafters. b) On or about March 2, 2016; floor openings located at on the second floor at the stair system; were not properly guarded to prevent employees from falling 10 feet to the lower level. c) On or about March 2, 2016; wall openings located on the second floor; were not properly guarded to prevent the employees from falling 12 feet to ground level while working near the openings. The Labran Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number1037237, citation number 1, item number 1a and was affirmed as a final order on 4/13/2015, with respect to a workplace located at 1100 W Street NW Washington DC 20009. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
