29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    (a) On or about March 2, 2016 and at times prior to that date, for the employees exposed to caught-in and/or amputation hazards while performing servicing and maintenance on equipment and machinery, to include but not limited to blade and belt changes on the DoAll metal cutting band saw, Model No. 2013-V, Serial No. 457-912084 located at 410 Sixth Street SE, Mandan, North Dakota.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:      (a) On or about March 1, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating the Delta metal cutting band saw with 1.5 inches of exposed blade under the table assembly located at 410 Sixth Street SE, Mandan, North Dakota.      (b) On or about March 2, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating the DoAll metal cutting band saw, Model No. 2013-V, Serial No. 457-912084 with over 3 inches of exposed saw blade under the table assembly located at located at 410 Sixth Street SE, Mandan, North Dakota.      (c) On or about March 2, 2016 and at time prior to that date, for the employees exposed to amputation hazards while operating the Grob, Inc. metal cutting band saw, model no. NS38, Serial No. 1333 with over 7 inches of exposed saw blade under the table assembly located at located at 410 Sixth Street SE, Mandan, North Dakota.      (d) On or about February 25, 2016 and at time prior to that date, for the employees exposed to caught-in and/or struck-by hazards while operating a Powermatic drill press, model no. 1200, serial no. 820V777 without chuck/chip guards located at located at 410 Sixth Street SE, Mandan, North Dakota.      (e) On or about February 25, 2016 and at time prior to that date, for the employees exposed to caught-in and/or struck-by hazards while operating a Powermatic drill press, model no. 1200, serial no. 820V558 without chuck/chip guards located at located at 410 Sixth Street SE, Mandan, North Dakota.
