OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees while operating a defective Kelley dock plate leveler.    Location: Loading dock    On or about 2/29/16, employees attempted to lift the defective Kelley dock plate leveler by use of un-rated chains tied in a knot to the mast of the Komatsu, model #25 FG25ST-16 forklift. The dock plate became stuck and one employee attempted to lift up on the dock plate and then the dock plate came crashing down on the employee's two feet, breaking both big toes of each foot.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:    Location: Loading docks    On or about 3/3/16, the employer did not provide guardrails at their loading docks and exposed employees to fall hazards of up to 4-feet, 2-inches while loading and un-loading trucks, disposing of waste, cardboard, wooden pallets in the following areas;  1. Dock #1 - Trailer loading and un-loading - employees exposed to fall hazards of greater than 4-feet, 1 and 5/8-inches.  2. Dock #2 - Waste disposal - employees exposed to fall hazards of greater than 4-feet, 2-inches.  3. Dock #3 - Cardboard disposal - employees exposed to fall hazards of greater than 4-feet, 1-inch.  4. Dock #4 - Wood pallet disposal/recycle - employees exposed to fall hazards of greater than 4-feet.
