On or about March 2, 2016, at the Hollywood Casino (Level C1) worksite, the employer did not develop and implement a respiratory protection program for employees voluntarily using half mask elastomeric respirators for protection against dust and/or other particulates, in that: (a) Employees were not medically evaluated prior to wearing half mask elastomeric respirators in the workplace. (b) Half mask elastomeric respirator(s) were stored and maintained in a clean and sanitary condition.

29 CFR 1926.404(b)(1)(iii)(C): Where an assured equipment grounding conductor program was being utilized, the employer did not ensure that each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, were visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage. (a) On or about March 2, 2016, and times there prior to, at the Hollywood Casino (Level C1) worksite, the Husky task light used in the main casino floor area was identified in service with a missing grounding pin. Employees were exposed to electrical hazards.
