29 CFR 1910.146(c)(3): When the employer decided its employees would not enter permit spaces, the employer did not take effective measures to prevent its employees from entering the permit spaces.  On or about March 04, 2016, and at times prior thereto, employees in the shop building were exposed to chemical and fire hazards while entering permit spaces, without the company taken effective measures to prevent its employees from entering the permit space.

29 CFR 1910.146(c)(5)(ii)(C): Before an employee entered a space, the internal atmosphere was not tested with a calibrated direct-reading instrument for oxygen, flammable gases and vapors and potential toxic air contaminants.  On or about March 04, 2016, and at times prior thereto, employees in the shop building were exposed to chemical and fire hazards while entering permit spaces without testing the internal atmosphere for oxygen content, for flammable gases and vapors, and for potential toxic air contaminants.

This violation occurred on or about February 26, 2016, where an employee was grinding on a tanker trailer got his left arm burned and the accident was not reported to OSHA within 24 hours.
