29 CFR 1910.119(j)(6)(ii): Appropriate checks and inspections were not performed to assure that equipment installed was consistent with design specifications and the manufacturer's instructions. In The Alternative OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or around March 7, 2016 and at times prior thereto at the Pasadena Refining System, Inc. facility in Pasadena, Texas, the employer did not identify, evaluate, and control the hazards involved in operating the Hydrogen and Light Cycle Gas Oil piping (10"-P-0112-Cs) circuit in high-temperature service for an extended length of time without establishing a corrosion rate and monitoring for depletion of wall thickness. AVD- At the Pasadena Refining System, Inc. facility, the employer replaced sections of a pipe segment with new metallurgy and left a section of old piping in place that was forgotten and not reflected in the process safety information and mechanical integrity program.

29 CFR 1910.119(j)(4)(ii): Inspection and testing procedures did not follow recognized and generally accepted good engineering practices. In The Alternative OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about March 5, 2016 and at times prior thereto, in the 62 Diesel Hydrotreater Unit at the Pasadena Refining System, Inc. refinery in Pasadena, Texas, the employer did not follow recognized and generally accepted good engineering practice (RAGAGEP) for Inspection and testing of the piping. Examples of such RAGAGEP include but are not limited to API RP 570 (Piping Inspection Code: In-Service Inspection, Rating, Repair, and Alteration of Piping Systems), API RP 571 (Damage Mechanisms Affecting Fixed Equipment in the Refining Industry), API RP 574 (Inspection Practices for Piping System Components) and API RP 939-C (Guidelines for Avoiding Sulfidation (Sulfidic) Corrosion Failures in Oil Refineries) For piping circuit 10"-P-0112-Cs the employer failed to: a) Identify a piping circuit in which sulfidation can occur in the mechanical integrity inspection plan. b) Evaluate the piping system based on present or possible damage mechanisms. c) Establish a corrosion rate for the piping circuit. d) Calculate and track wall loss caused by sulfidation corrosion.

In The Alternative OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On March 5, 2016 and at times prior thereto at the Pasadena Refining System, Inc. facility in Pasadena, Texas the employer did not inspect process piping circuit 10"-P-0112-Cs at frequencies consistent with recognized good engineering practice such as but not limited to API RP 570 (Piping Inspection Code: In-Service Inspection, Rating, Repair, and Alteration of Piping Systems) and API RP 571 (Damage Mechanisms Affecting Fixed Equipment in the Refining Industry) when: a) The employer failed to calculate corrosion rates for the piping on either a short-term or LT corrosion basis. (API RP 570 section 7.1.3) b) The period between thickness measurements exceeded five years. (API RP 570 Table 2)

On or about March 7, 2016 at the Pasadena Refining System, Inc. facility in Pasadena, Texas, the employer Piping and Instrumentation "Drawings (PIDs) for the 62 Diesel Hydrotreater Unit Unit were not accurate in the representation of the process. a) The employer's PID 62-11-F6202 does not accurately identify the material of construction for piping in the unit represented by line number 10"-P-0112-Cs that transmits process stream to the H-1 Pretreater Charge Vessel. b) The employer's PID 62-11-F6202 shows line 4"-SM0124-Af connected to the 150# Steam supply header when the line has been dead-legged in the field and does not connect the process line 10"-P-0112-Cs to the steam supply. c) The employer's PID 62-11-6222 does not accurately identify the material of construction for piping in the unit represented by line number 10"-P-0112-Cs that transmits process stream from E-1A heater to the H-1 Pretreater Charge Vessel.
