OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards: Employees were exposed to crush-by hazards while operating a forklift truck without wearing a seat belt. (a)At least one (1) employee was operating a forklift inside the building near coolers 4 & 5, Zone 3. (b) At least one (1) employee was operating a forklift without a seat belt outside at the back of the building. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the requirement, including describing the steps that it is taking to ensure that all forklifts are equipped with seat belts, and employees utilize them when engaged in the operation.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition were not removed from service. All repairs shall be made by authorized personnel: (a) Employees working in a warehouse were operating a powered industrial truck that was not maintained in good condition and were exposed to struck-by hazard.
