29 CFR 1926.453(b)(2)(v): A body belt or personal fall arrest system was not used with a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e):  East side of commercial construction:  On or about March 8, 2016, an employee was exposed to a fall hazard greater than 10 feet to the ground below, while removing plastic from windows of a commercial construction from the basket of a Skytrak telescopic handler, without the use of a personal fall arrest system.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about March 8, 2016, an employee was exposed to a fall hazard greater than 10 feet from the ground level below, while removing plastic from the windows of a commercial construction, without being trained regarding the proper practices to avoid a fall.
