29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting face piece respirator were not annually fit tested: On or about March 2, 1016, at Building 1 of the Naval Medical Center San Diego, the employer did not ensure that employees required to use tight-fitting respirators were fit-tested in that: (a) Employees were not fit tested for filtering face pieces or half face respirators in the last year by the employer, exposing them to respiratory hazards when painting. (b) An employee was not fit tested for a 3M Model 8210 Plus N95 filtering face piece respirator provided by the employer for use when painting.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103) On or about March 2, 2016, at Building 1 of the Naval Medical Center San Diego, an employee was permitted to use a tight fitting respirator with a full beard and moustache, exposing him to respiratory hazards when painting.

29 CFR 1910.134(h)(1)(i): Respirators issued for the exclusive use of an employee were not cleaned and disinfected as often as necessary to be maintained in a sanitary condition: (Construction Reference 1926.103) On or about March 2, 2016, at Building 1 of the Naval Medical Center San Diego, an employee was using a tight fitting respirator that was not properly cleaned and maintained in that there were dust particles and paint spatters on the inside surface of the respirator.
