29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a) Third floor, new townhome construction located at 2754 Avington Lane, Smyrna, GA 30080: Employee using a Pneutool Framing Nail Gun was exposed to eye injuries while operating this tool at 120 PSI with no protective eyewear. The employee was exposed to flying debris and fasteners as safety glasses and/or goggles were not worn.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) Third floor, new townhome construction located at 2754 Avington Lane, Smyrna, GA 30080: Employees were exposed to falls of approximately 24-feet to the lower level while engaged in framing activities with no fall protection system in place.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) Third floor, new townhome construction located at 2754 Avington Lane, Smyrna, GA 30080: Employees engaged in framing activities at heights of approximately 24-feet from the lower level were not provided with a fall protection system. The employees did not recognize the hazard and were not trained to use systems which would prevent falls to the lower level.
