29 CFR 1910.95(d)(1): The employer did not develop and implement a noise monitoring program to determine any employees exposure who may equal or exceed an 8-hour time weighted average of 85 decibels: In the mill area of the facility on and before March 15, 2016, the employer did not develop and implement a noise monitoring program. Employees conduct work in the mill area exposed to noise induced hearing loss. Injury/Illness: Exposure to prolonged excessive noise may result in tinnitus and noise induced hearing loss. Abatement note: A Hearing Conservation Program shall consist of: 1. Development and implementation of a noise monitoring program; 2. Notification to each employee exposed at or above an 8-hour TWA of 85 decibels. 3. Baseline audiograms within six months of an employees first exposure at or above 85 decibels and annual audiograms thereafter; 4. Providing hearing protectors to all employees exposed to an 8-hour TWA of 85 decibels or greater, employees that have not had a baseline audiogram, and any employees experiencing a standard threshold shift; 5. Instituting an annual training program for all employees who are exposed to noise at or above an 8-hour TWA of 85 decibels which includes information on the effects of noise on hearing, the purpose of hearing protectors, and the purpose of audiometric testing; 6. Retaining all records including noise exposure measurements and audiometric test records.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided in this paragraph by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels. New Alliance, at 9620 S. Railroad Ave, Bridgeport, NE 69336: On and before March 15, 2016, the employer did not ensure that employees exposed at or above 85 decibels for an 8-hour time-weighted average received audiometric testing. Employees in the mill area of the facility was not included in the company's hearing conservation program. An employee conducting work in the mill area was exposed to a continuous noise levels at 76% of the allowable 8-hour time-weighted average sound level (85 dBA). The equivalent dBA level of 76% is approximately 88 dBA. The sampling was performed for 480 minutes.
