29 CFR 1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed:  a) Hexa Americas, Inc. Sidney, Ohio; On or about March 15, 2016 the employer failed to ensure periodic inspections of energy control procedures were completed at least annually. Employees are required to perform A-clean operations on Reliance High Intensity Mixers located on the fourth floor, which require energy control procedures, have not been reviewed for deficiencies.

29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees:  a) Hexa Americas, Inc. Sidney, Ohio; On or about March 15, 2016; the employer failed to ensure lockout devices were affixed to the energy isolating switch associated  to the Reliance High Intensity Mixer #6 located on the fourth floor before employees began a change over. Employees engaged in changeover activities were exposed to caught in hazards if the mixer would startup accidently.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:  a) Hexa Americas, Inc. Sidney, Ohio; On or about March 15, 2016; the employer failed to ensure employees were trained in the purpose and function of the energy control program. Employees were required to perform A-cleans on Reliance High Intensity Mixers located on the fourth floor including but not limited to mixer #6.  Employees engaged in A-clean operations were exposed to caught in hazards from unexpected start-up of the equipment.

29 CFR 1910.147(f)(3)(ii)(D): Each authorized employee did not affix a personal lockout or tagout device to the group lockout device before working on the machine or equipment:  a) Hexa Americas, Inc. Sidney, Ohio; On or about March 15, 2016 the employer failed to ensure employees were protected while engaging in A-clean activities on mixer #6 in that group lockout procedures were not followed. Employees were exposed to caught in hazards due to a rotating spindle within the mixer in the event of an accidental start up.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely.  a) HEXA Americas, Inc. Sidney, Ohio; On or about February 28, 2016 the employer failed to ensure employees were provided with refresher training in powered industrial truck safety following an accident. On or about February 28, 2016 an employee operating a forklift in the warehouse struck a support column while moving product. The employee was not retrained exposing employees to struck by hazards.
