29 CFR 1926.451(g)(2): The employer did not have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds:    (a) Eastside of House - On or about March 14, 2016 the ladder jack scaffolding 28 feet high was not erected by a competent person to determine the feasibility and safety of providing fall protection for employees . Employees have no training in erecting or dismantling scaffolding and no one has been designated as the competent person.

29 CFR 1926.451(h)(1): Each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects.  For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall.       (a) Eastside of House - On or about March 14, 2016 employees working from the ladder jack scaffolding had tools and heavy air nail guns lying on the edge of the walking/working planks without any means of protection to keep them from falling and striking persons below.

(a) Eastside of House - On or about March 14, 2016 employees working on ladder jack scaffolding have not received any training by a qualified person to recognize, minimize, prevent and eliminate hazards associated with this type of scaffold being used.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system.       (a) Front of House - On or about March 14, 2016 employees working on ladder jack scaffolding gained access by climbing a ladder that was placed at the edge of the deck/porch.  Employees were not protected from falling from the deck/porch by the use of guardrail system, safety nets, or personal fall arrest system.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:         (a) Entrance, Front of House - On or about March 14, 2016 employees gained access to house and scaffolding using the stairway having four or more risers or rising more than 30 inches (76 cm), whichever is less, that were not equipped with at least one handrail and one stair rail system along each unprotected side or edge. Employees were exposed to falling up to 20 feet to a lower level.
