OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to atmospheric hazards during manure pit entry. On or about February 17, 2016, employees were exposed to toxic manure gases while performing maintenance activities on the pumps located in the underground pits that collected cow manure from the cattle barns. Among other acceptable methods, a feasible abatement method would be to follow the guidelines stated in the American National Standards Institute/American Society of Safety Engineers (ANSI/ASSE), Standard Z117.1-2009 Safety Requirements for Confined Spaces, including developing and implementing a permit required confined space program, training all employees on the permit required a confined space program procedures that are developed, and assessing the workplace to identify and label all confined spaces present on the property.
