Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a serious fall hazard related to a damaged mobile ladder stand: a) Warehouse Work Area: On or about March 24, 2016, a Ballymore 12-foot mobile ladder stand was being used to reach products on shelving units, but the right leg beneath the bottom stair tread was bent and missing its end cap creating a potentially unstable condition, which exposes employees to a fall hazard of up to 12 feet. ABATEMENT NOTE: Among other feasible means of abatement, an appropriate method for access to or egress from any step or platform may be attained per the guidance found in ANSI A14.7 - 1991, Paragraph 6.3 which states "Units that are damaged or weakened from any cause shall not be used until repairs are completed".
