OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. a) Bharatiya Temple, Worksite - on or about March 16, 2016, masons were using a JLG G6-42A Telehandler to raise and horizontally extend a scaffold platform to a working height of approximately 33 feet above grade, but the scaffold platform was not an approved attachment for this model of telehandler. b) Bharatiya Temple, Worksite - on or about March 16, 2016, masons were using a JLG G6-42A Telehandler to raise and horizontally extend a scaffold platform to a working height of approximately 33 feet above grade without an operator being readily available to lower the platform, as the telehandler does not have operator controls available for the platform. Among other feasible means of abatement, the employer may follow the guidelines of ANSI / ITSDF B56.6 - 2011, Paragraph 5.15.1a, which states that the employer must "provide a personnel platform which complies with the design requirements listed in Part III of this Standard"; and Paragraph 5.15.1s, which states "a trained operator shall be in position to control the rough terrain forklift truck, or available to operate controls if the platform is not equipped with controls. When the operator is not in the operating position, block the truck wheels and apply the parking brake with all travel controls in neutral".
