29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1): a) Brooklyn Public Library (BPL) at 1044 Eastern Parkway, Brooklyn, NY 11213. A contractor's employees working for the BPL and a BPL's employee were exposed to asbestos hazard during renovation project. BPL did not fulfill its duties to determine the presence and location of ACM or PACM before initiating renovations work in a building built at or around 1908. The condition was noted at or around November 10, 2015. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
