Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazard of being struck by work vehicles/equipment traffic: a) On March 17, 2016, an employee operating a Caterpillar Bulldozer D5G to level the ground at 4504 Sydney Rd. Plant City (FL). Surveying contractors were on foot, behind and in close proximity to equipment's blind spot areas when an employee was struck by the bulldozer tracks while it was backing up, as observed on or about March 23, 2016.
