29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) In the pallet manufacture area, on or about 03-23-2016, the employer did not implement a hearing conservation program for the employee manufacturing/building pallets using a "Max" coil nail-gun who was exposed to sound levels exceeding the OSHA Action Level.  The employee was exposed to continuous noise at 226% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 97.2 dBA during the 396 minute sampling period; exposure calculations included a zero increment for the 84 minutes not sampled.   b) In the sawmill area, on or about 03-23-2016, the employer did not implement a hearing conservation program for the employee processing lumber using a "Morgan Machinery" sawmill equipment who was exposed to sound levels exceeding the OSHA Action Level.  The employee was exposed to continuous noise at 180% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of approximately 89.2 dBA during the 370 minute sampling period; exposure calculations included a zero increment for the 110 minutes not sampled.

The employee was exposed to continuous noise at 226% of the permissible daily noise (8-hour time-weighted average sound level of 90 dBA) or an equivalent sound level of approximately 97.2 dBA during the 396 minute sampling period; exposure calculations included a zero increment for the 84 minutes not sampled.

The conductors were exposed to potential damage to the insulation due to the equipment's abrasion and vibration, exposing the employees to contact with energized metal parts.
