29 CFR 1910.95(k)(1): The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section, including: (1) the effects of noise on hearing (2) the purpose of hearing protectors, the advantages, disadvantages, and attenuation of various types, and instructions on selection, fitting, use and care. The employer shall institute a training program and ensure employee participation in the program. On or about March 30, 2016, in the facility, employees required to perform wood pallet assembly operations were exposed to noise at or above an 8-hour time weighted average of 85 decibels: a. An employee required to operate a pallet dismantler machine was exposed to continuous noise at an 8-hour time-weighted average (TWA) sound level of approximately 91.0 decibels. b. An employee required to operate a pallet dismantler machine was exposed to continuous noise at an 8-hour time-weighted average (TWA) sound level of approximately 89.0 decibels. c. An employee required to operate a pneumatic nail gun was exposed to continuous noise at an 8-hour time-weighted average (TWA) sound level of approximately 88.7 decibels. The employer did not train each employee exposed to noise at or above an 8-hour time-weighted average of 85 decibels.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment: On or about March 30, 2016, on the facility, employees required to perform wood pallet manufacturing, including saw cutting and nail gun operations, were exposed to eye and hand hazards necessitating the use of personal protective equipment. The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed.

29 CFR 1910.134(k)(6): The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer: On or about March 30, 2016, in the facility, employees required to perform wood pallet manufacturing operations, including, but not limited to, operating pallet dismantler saw machines, wore filtering facepiece (dust mask) respirators voluntarily. The employer did not provide each employee with the basic advisory information in Appendix D.
