29 CFR 1926.501(b)(13): Employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net systems or personal fall arrest systems: On or about March 22, 2016 and at times prior thereto, employees were working on the roof of a residential home without any form of fall protection. The employees were exposed to fall hazards of more than six feet to the ground below.

29 CFR 1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill: On or about March 21, 2016 and at times prior thereto, the employer did not ensure his employees were retrained in any inadequacies that were indicated in their knowledge or use of fall protection systems. The employees were exposed to fall hazards of greater than six feet to the ground below.
