29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a) Powered industrial vehicle operators did not receive formal and operational training, in order to fully evaluate their competency to operate including powered industrial truck such as but not limited to sit-down forklifts.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. a) On March 1, 2016 while feeding material into the American Conveyer #907 press machine, guarding was not attached and/or installed to prevent employees hands from entering the pinch points created.
