29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1): Boiler/Electrical Room: Employees of an electrical contractor were hired to perform work in an area where exposed elbow pipe insulation was present. The insulation located in two areas was confirmed 75% and 80% Chrysotile asbestos. The building owner did not determine the presence, location and quantity of asbestos containing material, thus exposing employees of multi-employer contractors to inhalation of asbestos fibers, on or about, 3/29/16.

29 CFR 1926.1101(k)(2)(ii)(C): The building owner and/or facility owner did not notify all employers of employees who work within or adjacent to the areas containing asbestos containing materials (ACM) and presumed asbestos containing materials of the presence, location and quantity: Boiler/Electrical Room: Employees of an electrical contractor were hired to perform work in an area where exposed elbow pipe insulation was present. The insulation was confirmed as 80% Chrysotile asbestos. The building owner did not notify employers of employees performing work in the 80 year old building of the presence, location and quantity of asbestos containing material, thus exposing employees of multi-employer contractors to inhalation of asbestos fibers, on or about, 3/29/16.
