29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a.  On or before March 18, 2016, the employer failed to instruct an employee working as a distribution technician in the recognition and avoidance of unsafe conditions of working in and around trenches and excavations and the regulations applicable to control and/or elimination of the hazards working in and around trenches and excavations.      b.  On or about March 29, 2016, the employer failed to ensure an employee working as a distribution technician was instructed in the recognition and avoidance of unsafe conditions of working inside a trench and the regulations applicable to working inside a trench with a varying depth of approximately 4.8 feet to approximately 8 feet deep.

On or about March 29, 2016, during the installation of a water line offset near 6684 Heisley Road, Mentor, Ohio, the employer did not ensure employees working inside a trench, with varying depth of approximately 4.8 feet to approximately 8 feet deep and near 90 degree vertical walls, was protected from cave-ins by an adequately designed protection system.  The soil was classified as; Cohesive, type B.

AQUA OHIO, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.651(J)(2), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 949323, CITATION NUMBER 01, ITEM NUMBER 002, AND WAS AFFIRMED AS A FINAL ORDER ON OR ABOUT JANUARY 28, 2014, WITH RESPECT TO A WORK PLACE LOCATED AT 1226 ELK DRIVE, ASHTABULA, OHIO.
