29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a) Porte Cochere roof, Provident Village at Creekside Assited Living located at 4838 South Cobb Drive, Smyrna, GA 30082. Employee was exposed to falls of approximately 16-feet, 8-inches to the lower level as no fall protection system was in place. The employee was performing stucco work and was not protected from falls to the lower level.

29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection.  (a) Porte Cochere roof, Provident Village at Creekside located at 4838 South Cobb Drive, Smyrna, GA 30082: The employer failed to provide an adequate fall protection system before his employee began work from the roof at heights of approximately 16-feet, 8-inches from the lower level. No anchor point was provided by the employer for the exposed employee to use as a tie off point. The employer failed to ensure that an adequate fall protection system was being used prior to exiting the site.
