29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) Stairwell on first floor, new residential construction located on Lot #17 Devoncroft Street, Smyrna, GA 30080: The ladder provided to access the upper level did not have side rails which extended 3 feet above the landing surface to allow for safe access on and off the upper level. Employees using this ladder were exposed to falls of approximately 10-feet, 6-inches to the lower concrete surface.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  (a) First floor, new residential construction located on Lot #17 Devoncroft Street, Smyrna, GA 30080: Employees were exposed to falls of approximately 5-feet, 10-inches while using a damaged 6-ft. Werner Step Ladder which had a damaged spreader bar which was replaced by an orange wire. Employees using this ladder were exposed to collapse and fall hazards to the lower concrete surface.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) Second floor, residential construction located on Lot #17 Devoncroft Street, Smyrna, GA 30080: Employees were exposed to fall hazards while engaged in framing activities at heights of approximately 11-feet, 5-inches with no fall protection system in place.   Vidal Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 899905, citation number 1, item number 1 and was affirmed as a final order on 07/30/2013, with respect to a workplace located at 345 Scott Farm Drive, Powder Springs, GA 30127.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  (a) North side, new residential construction located on Lot #17 Devoncroft Street, Smyrna, GA 30080: The employer failed to inspect all of the electrical cords prior to the start of the work shift. Flexible cords used to power equipment on site had damaged strain relief and some of the protective casing on the cords were repaired with electrical tape and were not removed from service.
