OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burn, amputation and crushed-by hazards created by point of operation, ingoing nip points, and rotating parts of a bagging machine.    a) Bay #2, 734 West Penn Pike, Tamaqua, PA - On a daily basis the employees operated the Sheldahl Bagging Machine #5 Model No. B-308 (Serial No. GS-3152) with a missing e-stop cable (which rendered an emergency stop device inoperable) thereby exposing employees to burn, caught-in, and crushed-by hazards in the event of an emergency when clearing jams, as observed on or about March 30, 2016.  In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. The hazardous condition was corrected during the inspection.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling.  a) Northeast corner, "Purdue" Bagging Machine, Bay #2, 734 West Penn Pike, Tamaqua, PA - On a daily basis, employees used the on/off switch on a power strip (relocatable power tap-RPT) and a "daisy chained" extension cord (flexible power cord) to provide electrical power to a water pump when operating the "Purdue" Bagging Machine thereby exposing employees to a contact with an electrical current hazard, on or about March 30, 2016.  b) Northwest wall, Bay #2, 734 West Penn Pike, Tamaqua, PA - On a daily basis, employees used the on/off switch of a power strip (relocatable power tap-RPT) whose power cord was "daisy chained" to an extension cord (flexible power cord) to provide electrical power to a microwave oven thereby exposing employees to contact with an electrical current hazard, as observed on March 30, 2016.    In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. The hazardous conditions were corrected during the inspection.

29 CFR 1910.305(g)(1)(iv)(A): Flexible cords and/or cables were used as a substitute for the fixed wiring of a structure.  a) Northeast corner, "Purdue" Bagging Machine, Bay #2, 734 West Penn Pike, Tamaqua, PA - On a daily basis, for a period of time that exceeded six (6) months, employees used a "daisy chained" extension cord (flexible power cord) to provide electrical power to a water pump when operating the "Purdue" Bagging Machine thereby exposing employees to a contact with an electrical current hazard, on or about March 30, 2016.  b) Northwest wall, Bay #2, 734 West Penn Pike, Tamaqua, PA - On a daily basis, for a period of time that exceeded six (6) months, employees used an extension cord (flexible power cord) to provide electrical power to a microwave oven thereby exposing employees to contact with an electrical current hazard, as observed on March 30, 2016. 29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.   a) Sheldahl Bagging Machine #5, Bay #2, 734 West Penn Pike, Tamaqua, PA - An employee sustained a work-related injury that resulted in an amputation of the right index finger distal phalanx (first knuckle). The amputation was not reported by the employer to OSHA within twenty-four (24) hours, on or about November 17, 2015.  In accordance with 29 CFR 1903.19(c), abatement certification is not required for this violation. The hazardous condition was corrected during the inspection.
