29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. The employer does not require the use of any form of fall protection during construction work by subcontractors. This violation was most recently observed on March 30, 2016 where subcontractor's employees were not protected from falls while framing the roof gable of a two story house, thereby exposing employees to a 21 foot fall hazard.  b. The employer does not require the use of any form of fall protection during construction work by subcontractors. This violation was most recently observed on March 30, 2016 where an subcontractor's employee was not protected from falls from a wall opening that was not guarded while framing a two story house, thereby exposing employees to a 11 foot 5 inch fall hazard.  To abate this violation, the employer must ensure that employees of subcontractors performing framing work are protected from falls by guarding all wall openings, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.  Manual Velazquez was previously cited for a repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1005002, citation number 2, item number 2 and was affirmed as a final order on January 14, 2015 with respect to a workplace located at 5585 Harvest Curve Lane, Canal Winchester, Ohio 43110.  Manual Velazquez  was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 966287, citation number 1, item number 2 and was affirmed as a final order on July 8, 2014, with respect to a workplace located at 294 Ravensdale Place, Galloway, Ohio 43119.  Manual Velazquez was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 607820, citation number 1, item number 1 and was affirmed as a final order on October 23, 2012 with respect to a workplace located at 5662 Marshfield Drive, Westerville, Ohio 43081.  Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
