29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.   a) On or about March 28, 2016; throughout the site; employees operating pneumatic nail guns were not wearing eye protection to protect them from potential flying objects during the process.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about March 28, 2016; Westside; employees were exposed to an estimated 18 foot fall to ground level while working near the edge or walking the plate while installing the second floor trusses.    b) On or about March 22, 2016; Second floor of the residential home; employees were exposed to a 10-15 foot fall to ground level while working near wall openings within the first floor area.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification.  This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) On or about March 28, 2016; rear of residential home; An extension ladder  used to access the second floor was 6 inches above the platform exposing employees  to a potential fall hazard of 10 feet to ground level.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
