29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. (a) Off Hwy 55 in Hazlehurst, MS - On or about March 28, 2016 an employee was exposed to a falling object hazard while working beneath loose soil inside at least 5.6 feet deep trench including the spoil pile. This employee was not wearing hardhat while an excavator was in operation.

29 CFR 1926.652(a)(1)(ii): Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in. (a) Off Hwy 55 in Hazlehurst, MS - On or about March 28, 2016 an employee was exposed possible cave-in of loose soil due to the fact no soil classification was made prior to an employee working inside this trench with no cave-in protection.

29 CFR 1926.651(j)(2): Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. (a) Off Hwy 55 in Hazlehurst, MS - On or about March 28, 2016 an employee was working inside at least 5.6 feet deep trench with spoil pile directly next to the excavation. The spoil pile was not moved 2 feet away from the edge of the excavation.
